This document sets forth the terms and conditions for the use of the website tiny-home.xyz, which offers solutions based on blockchain technology.

Definitions
To allow for a complete understanding and acceptance of these terms and conditions, the following terms, both singular and plural, shall have the meanings as indicated below:

Application: the website tiny-home.xyz.
User: any individual who accesses and uses the Application.
Conditions: this contract governing the relationship between the Owner and the Users.

Scope of Application of the Conditions
The use of the Application implies the User's acceptance of the Conditions. Should the User not intend to accept the Conditions and/or any other notice, legal notice, information published or referred to therein, they shall not be able to use the Application or its related services. The Conditions may be modified at any time. Any changes will be effective upon their publication on the Application. Before using the Application, the User is required to carefully read the Conditions and save or print them for future reference. The Owner reserves the right to vary, at its discretion, the graphic interface of the Application, the Contents, and their organization, as well as any other aspect that characterizes the functionality and management of the Application, by communicating to the User, if necessary, the relevant instructions.

The Contents and/or materials available on the Application are made available on the terms of the "Creative Commons Public License CC BY-NC 4.0 IT" (hereinafter the "License"). The Contents and/or materials available on the Application are protected by copyright, by other rights granted by copyright law (related rights, rights on databases, etc.), and/or by other applicable laws. Any use of the contents and/or materials available on the Application that is not authorized under the License and/or other applicable laws is prohibited. The Owner grants the User the rights listed below on the condition that the User agrees to comply with the terms and conditions of the License. The Owner allows the User to reproduce, distribute, communicate to the public, perform, recite, transform the contents and/or materials available on the Application by any means and format, but not for commercial purposes, provided that the User is attributed authorship and provides a link to the license and indicates if any modifications have been made. Disclaimer
The Application is provided "as is" and "as available," and the Owner makes no express or implied warranties regarding the Application, nor does it provide any warranty that the Application will meet the Users' needs or that it will be uninterrupted or error-free or that it will be free from viruses or bugs. The Owner will endeavor to ensure that the Application is available uninterrupted 24 hours a day, but cannot be held responsible if, for any reason, the Application is not accessible and/or operational at any time or for any period. Access to the Application may be temporarily suspended without notice in case of system failure, maintenance, repairs, or for reasons entirely beyond the Owner's control or due to force majeure events.

Limitation of Liability
The Owner shall not be liable to the User, except in cases of willful misconduct or gross negligence, for malfunctions or failures related to the use of the internet network beyond its control or that of its suppliers. The Owner shall also not be liable for damages, losses, and costs incurred by the User as a result of the non-performance of the contract for reasons not attributable to them. The Owner assumes no responsibility for any fraudulent or unlawful use that may be made by third parties of credit cards and other means of payment. The Owner shall not be liable for: - any loss of business opportunity and any other loss, even indirect, suffered by the User that is not a direct consequence of the Owner's breach of contract. - incorrect or inappropriate use of the Application by Users or third parties. In no event shall the Owner be liable for an amount exceeding double the cost paid by the User.

Force Majeure
The Owner shall not be considered liable for the non-performance or delayed performance of its obligations due to circumstances beyond its reasonable control caused by force majeure events or, in any case, by unforeseen and unpredictable events, and, in any case, independent of its will. The performance of the Owner's obligations shall be suspended for the duration of force majeure events. The Owner shall take any action within its power to identify solutions that allow for the correct performance of its obligations despite the persistence of force majeure events.

Links to Third-Party Sites
The Application may contain links to third-party websites/applications. The Owner exercises no control over them and, therefore, is in no way responsible for the contents of these websites/applications. Some of these links may refer to third-party websites/applications that provide services through the Application. In these cases, the general terms and conditions for the use of the website/application and the use of the service prepared by third parties shall apply, for which the Owner assumes no responsibility.

Privacy
The protection and processing of personal data will take place in accordance with the Privacy Policy that can be consulted on the page tiny-home.xyz/privacy.

Applicable Law and Jurisdiction
The Conditions are subject to Italian law. For Professional Users, for any dispute relating to the Application, execution, and interpretation of these Conditions, the competent court is the court of the place where the Owner is based. For Consumer Users, any dispute relating to the application, execution, and interpretation of these Conditions shall be referred to the court of the place where the Consumer User resides or has elected domicile, if located within the territory of the Italian State, without prejudice to the Consumer User's right to appeal to a different judge from that of the "consumer court" pursuant to Article 66 bis of the Consumer Code, competent territorially according to one of the criteria provided for in Articles 18, 19, and 20 of the civil procedure code. Consumer Users who do not have their habitual residence in Italy shall benefit from any more favorable and mandatory provisions provided for by the law of the country where they have their habitual residence, in particular with regard to the deadline for exercising the right of withdrawal, the deadline for returning the Products, in case of exercise of such right, the methods and formalities for communicating the same, and the legal guarantee of conformity.

Online Dispute Resolution for Consumer Users
Consumer Users residing in Europe should be aware that the European Commission has established an online platform that provides an alternative dispute resolution tool. This tool can be used by Consumer Users to resolve non-judicially any dispute relating to and/or arising from contracts for the sale of goods and the provision of services entered into online. Consequently, Consumer Users can use this platform to resolve any disputes arising from the contract concluded online. The platform is available at the following address: ec.europa.eu/consumers/odr.
